1. Services Provided
Joshua Wells offers custom, tailored design services for each client. Every project is unique and follows a set timeline and proposal, as agreed upon at the start of the project. All work is based on the specific requirements outlined in your project proposal.
2. Pricing & Payment Terms
Clear pricing will be provided in your project proposal with no hidden fees. Payment schedules will also be clearly stated, and clients may be required to make a deposit before work begins. Full payment must be made upon project completion unless otherwise specified in the agreement. Any additional costs, such as third-party services or expedited timelines, will be disclosed prior to incurring them.
3. Refunds & Cancellations
Refunds for services are handled on a case-by-case basis, given the tailored nature of our design solutions. If a client wishes to cancel the project, any work completed up to the point of cancellation will be invoiced, and the deposit is non-refundable. Any refund request must comply with the terms agreed upon in the project proposal and applicable legal requirements.
4. Revisions & Changes
Clients are entitled to revisions as outlined in their project proposal. Any additional revisions or significant changes beyond the agreed-upon scope may incur extra charges and impact the project timeline. Communication regarding revisions is key to ensuring a smooth process, and clear documentation will be kept.
5. Delivery of Digital Goods
For digital goods and services, delivery methods and deadlines will be outlined in the project proposal. The client will be informed of when and how the final deliverables will be provided, and once the project is delivered, it is considered complete. If a digital product does not meet the client’s expectations, options such as revisions or refunds will be discussed based on the original project terms.
6. Dispute Resolution
In the event of a dispute, clients are encouraged to contact Joshua Wells to discuss concerns. We will strive to resolve issues through open communication and negotiation. If necessary, disputes may be escalated to mediation or arbitration as a final step, with each party responsible for their own legal costs.
7. Client Communication & Documentation
All communication, including emails and phone calls, will be documented to protect both parties in case of any disputes. This record will be essential for clarifying project decisions and handling any refund or chargeback claims. Regular updates and open lines of communication help prevent misunderstandings.
8. Ownership & Intellectual Property
Upon full payment, clients will receive ownership of the final design files. Joshua Wells retains the right to showcase completed projects in portfolios, marketing, and promotional materials unless otherwise agreed.
9. Chargebacks
Clients should contact Joshua Wells to resolve any payment disputes before initiating a chargeback. Chargebacks are costly and time-consuming for all parties involved, so we ask clients to communicate any concerns to avoid this route whenever possible.
10. Governing Law & Changes to Terms
These terms and conditions are governed by the laws of California. We reserve the right to update or modify these terms at any time. Any changes will be posted, and continued use of our services after such updates indicates your acceptance.
